Guideline ‘Contracting outside the Netherlands’

Dutch NGOs are increasingly hiring staff outside the Netherlands. This comes with challenges, as they often do not have a legal entity in the countries where they hire these employees. As an organisation, how do you know what kind of contract to offer?

Some NGOs enter into a consulting agreement, others into an employment agreement under Dutch law, and still others into an agreement through an Employer of Record. In addition, many NGOs lack the capacity and knowledge to conclude agreements that meet the labour law, tax and social security requirements in the countries where the employee works or lives.
